Terms of sale
What you're buying, how you receive it and what happens if something goes wrong. Written to be understood.
1. Seller
[COMPLETAR: tu nombre y apellidos, o la razón social] (Tax ID [COMPLETAR: NIF/DNI]), with the details shown in the legal notice. Contact: [COMPLETAR: email de contacto].
2. What you're buying
A personalized digital Christmas card: a one-of-a-kind web page with your photos, your message, the theme you choose and, optionally, a Christmas song, a voice message and an opening date. It's delivered as a link and a QR code, with nothing physical.
- Card: €9.90 / $9.99
- Optional “mini album” extra (a page with 3-5 photos and a caption for each): €2.99 / $2.99
You pay in euros in Europe and in US dollars elsewhere. The price you see before paying is the final price (in euros, VAT included). Your bank may charge exchange fees if your card is in another currency.
3. How to buy
- Create the card in the step-by-step builder and review the summary.
- Pay by card through Stripe's secure checkout. Before paying you accept these terms and the waiver of the right of withdrawal (section 5).
- As soon as the payment is confirmed, we prepare your card (usually in seconds) and show you the link and QR code. If you left your email, we send it to you as well.
The contract is concluded when the payment is confirmed. Stripe emails you the payment receipt.
4. Link availability
The card can be viewed for 90 days from its opening date (or from the purchase, if it opens right away). After that we delete it to protect everyone's privacy (see privacy). If you want to keep the memories, you can save the photos or download the tags and social media image we provide.
If you choose an opening date, the recipient will see a countdown until then (based on your device's time zone when you created it). Anyone with the link can view the card: share it only with whoever you want.
5. Right of withdrawal
As a consumer in the EU you would normally have 14 days to withdraw from a distance purchase. However, the law excludes this right for digital content that is prepared and delivered immediately with your express consent, and for goods made to your specifications (Article 103(c) and (m) of Spanish Royal Legislative Decree 1/2007, implementing Directive 2011/83/EU). That's why, before paying, we ask you to tick a box agreeing that we prepare your card immediately and acknowledging that, once prepared, you lose the right of withdrawal.
This doesn't affect your rights if the card doesn't work as described (section 6).
6. If something goes wrong
If your card isn't generated, doesn't display properly or doesn't match what you created, write to [COMPLETAR: email de contacto] with the link. We'll fix it and, if that's not possible, refund you. Digital content is covered by the legal guarantee of conformity.
7. Your content
- The photos, texts and audio you upload remain yours.
- You allow us to store them, adapt them (for example, resize or crop photos) and display them in your card, solely to provide the service and for the period in section 4.
- You guarantee you have the right to use them and permission from the people in them (and, if they are minors, that you are their parent or guardian or have their authorization).
- Illegal or offensive content, content that harasses or impersonates someone, or that infringes the rights of others is not allowed. We may remove a card that breaches this without a refund.
8. Artificial intelligence
If you use the message writing help or the photo “magic touch”, the result is generated automatically by an AI. It may not be perfect, which is why you see it (and can change or discard it) before paying. The number of photo attempts is limited. Don't use these features to create misleading images of real people or content that breaches section 7.
9. Music
Christmas songs are played with Spotify's player, which may only play a snippet for people who aren't signed in. Availability depends on Spotify.
10. Governing law and complaints
These terms are governed by Spanish law, without prejudice to the rights granted to you as a consumer by the law of your country of residence. If you have any problem, write to us first: we're sure we can sort it out. You may also turn to consumer arbitration bodies or the courts of your place of residence.
